L MULTINATIONAL TRANSFEREES

If you are a multinational enterprise, your company wants to transfer an employee abroad into the US, you need to meet the following requirements:

1. the employee must be employed in a managerial or executive capacity as continuously abroad for one of the past three years;

2. both US company and foreign company must be qualifying organizations, such as parent, branch, affiliate, or subsidiary;

3. employee must continue to work in managerial, executive or specialized skill;

L-1 petition is approved for 3 years except 1 year for new office. Maximum years for executive or managerial position are 7 years and 5 years for specialized knowledge employees.

If the US company has been doing business in US for one year, has three or more domestic and foreign branches, subsidiaries or affiliates with a combined US annual sales of $25 million, US workforce of 1,000 or received approval of at least 10 individual L petitions in last 12 months, your company may be qualified for blanket L-1.

However, if your company or employee is not qualified for the L-1 requirements, you still transfer your employee under H-1 visa if all H requirements are met.
