REMOVAL OF CONDITIONAL RESIDENCE STATUS

 If the EB-5 petition were approved, permanent residence is granted for a period of two years. The alien investor, and his or her family, must file another petition within 90 days prior to the second anniversary of the grant of residence to remove the conditions with appropriate USCIS service center. The petition must accompany with following evidence  


1. new commercial enterprise was established;
2. the alien investor had invested or was actively investing the required capital;
3. the investment and the new commercial enterprise are sustained; and
4. creation of 10 full-time employment.
 USCIS will terminate alien’s residence if the above conditions are not met.

 Also, if the alien investor fails to file to remove the condition, the conditional resident’s status will be automatically terminated and initiation of removal proceedings will be brought against the alien and family by USCIS to the immigration court.
